As many of you know, KC music has been made available for download on various services, including mobile 'phones, at different times & in various territories, for the past 3 or 4 years. NONE of these downloads were licensed, authorised or legitimised. that is, every single download of any KC track represents copyright violation. or, to use one syllable instead of seven, theft.

The two corporations who have made the music (illegally) available, are EMI & Sanctuary Universal. we have been in ongoing discussions with EMI regarding their unauthorised downloads as part of our dispute in respect of large sums of under-accounted royalties.

However, we are currently experiencing considerable difficulties in our dealings with Sanctuary Universal, who appear unable / unwilling to provide us with any information as to which services KC music has been made available to for downloading, nor when.

So, may i appeal to the Friends Of Wild Onion to go searching in your territory & find if you are able to download any KC, on any device, from any service provider; particularly material from The Power To Believe & Happy To Be Happy, please? and notify me directly c/o...

Rhapsody Part II

Acknowledging that helpful people can be a nuisance, I called Rhapsody’s Legal counsel. Before KC TPTB was taken offline, I bought a single song, .99 cents. Although I had thought quite frankly that this purchase was illegit, I did it not to defraud Mr Fripp and the boys, but rather to enter into a consumer relationship with Rhapsody so that after the crap hit the fan, I could be a nuisance to them.

Now that Mr Fripp, that Venal Heartless and Raging Leader of a man), has indicated I had been duped into engaging in copyright infringement, My questions to Rhapsody’s legal counsel were this:

Since this was illegally sold to me, can I get my money back ?

Had Rhapsody knowingly engaged in fraud ? How can I be sure the rest of their offerings are legit ?

I told them that I was greatly distressed by this matter, that they had created a great moral dimemna for me, that they had created a situation that hurt me psychologically, as well as, violating my rights as a consumer.

Sometimes you have to know the little key phrases to use, like: "As a shareholder, i am very distressed that I may very well need to begin litigation over less than a dollar amount, but of course perhaps there is a "class" of people being defrauded,"  and " who can I speak to about compliance with the Sarbanes-Oxley Act, I believe we have a situation here where there may very well be much more risk to the company, that what is being told to the shareholder’s"

The person I talked to was aware of the KC "event" as he called it, and assured me that all was well with the world, all would be remedied with DGM, and that the fault lies not with Rhapsody, but with the "publisher of record" for making the catalogue available.

It was fun to fuck with the guy. If I get my 99 cents back, I’ll send it along. There was alot more to the phone call, and of course I was just being a dick, but I’ll say I wouldn’;t find it very funny if it was my bread and butter they were stealing.
