13.12    A call to DGM HQ & the decision was taken to drive down, within a weather-window of the afternoon. Sadly, also decided following a call to Jordan Bracewell the Demon Guitarist: erring on the side of caution, given the uncertainties on the road network, to postpone Jordan’s visit to DGM tomorrow for recording with Soundscapes.

16.34    DGM HQ.

Crossing the M4, dividing Wiltshire N&S, the weather zone abruptly changed from mainly-clear North, to snowing heavily in several places South. Arriving at DGM just before 16.00, and about in time before the temperature fell below zero. Some heavy snowing, beginning to slush & on its way to ice. The forecast for tonight is -3C, and this is not a good time to be out of central heating oil.

17.28    A call has just come in from Sanctuary UMG, from the boss of the Second Tier Lawyer who has been blocking us for 15 months. Mr. SWTL’s Boss was able to acknowledge immediately something that the STL has evaded for 15 months – yes, a mistake has been made by S/UMG.

I have no problems with mistakes. A mistake is made, recognised & acknowledged. The mistake then becomes a difficulty to be addressed.

I have major problems with lawyers telling me that, not only have no mistakes been made, but they have no responsibility for those mistakes (which have not been made, in any case).

One of the topics addressed with Mr. Boss was a telephone comment to David made by the STL: why wouldn’t you want us to download your material? David had mentioned this to me in our kitchen-discussion upon my today afternoon-arrival. The answer/s flew back…

1.    It damages our business & business model.
2.    S/UMG have used unapproved masters.
3.    You may sell it, but we don’t get paid! We have received no accounting for any of the downloads.

All of which constitutes, I suggest, constructive negligence.

This is the short version, quick guide to a large & systemic structural flaw within the current music-industry-download model.

Nevertheless, this represents a major step forward in a period of, now 15 months, in which my creative attention has been engaged in dealing with industry abuses from two of the largest players in the world.

did anyone really think that message by fripp was about new dates, some live activity or a secret album with an uber line is released recorded back in the 80s and the master was found in some dudes attic?

Mikhail’s post would be sweet, were it not also indicative of an ongoing tragedy.

The concern of the musician is music. The concern of the professional musician is fighting to extract accurate & timely accounting and payment for their work. Were it not for the ongoing heroism of David Singleton at DGM, Declan of distributor Panegyric, and Artist Advocate Andy, with a few comments from the RHVL, the KC catalogue would have been downgraded, degraded, stomped upon & rendered pretty lifeless. And this after it was nearly killed in 1991 by Endless Grief.

So, regrettably, currently this is my professional life.

23.07    An electric fire has rendered warmth to this office, in the absence of heating oil. After a month of hustling our old & former supplier, our new supplier promises delivery before the end of the week.
